1. Introduction

Welcome to Mindoxa. These Terms of Service ("Terms") govern your use of our website, products, and services ("Services"). By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Services.

2. Communications

By creating an account or contacting us, you agree to receive communications from us, including via email, text message, calls, and push notifications. You can opt out of certain communications.

3. Services

Mindoxa provides digital marketing services including but not limited to website development, SEO, Google Ads management, social media management, app development, video editing, GMB reinstatement, and lead generation. The specific details, deliverables, and timelines for each service will be outlined in a separate agreement or proposal.

4. Payments and Fees

Fees for our Services are set forth in the applicable proposal or agreement. Unless otherwise specified, all fees are quoted in AED (United Arab Emirates Dirham). Payment terms will be specified in your agreement, and may include upfront payments, milestone payments, or recurring monthly fees depending on the service.

5. Intellectual Property

Upon full payment, clients will own the deliverables specifically created for them as outlined in their agreement. Mindoxa retains ownership of all proprietary tools, processes, and materials used to create the deliverables. Mindoxa reserves the right to display and link to your project as part of our portfolio and to write about the project on websites, in magazine articles, and in books about design.

6. Client Responsibilities

Clients are responsible for providing timely feedback, content, and approvals as outlined in the project timeline. Delays in client feedback may result in project delays. Clients are responsible for the accuracy and legality of all content and materials they provide.

7. Limitation of Liability

In no event shall Mindoxa, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.

8. Termination

Either party may terminate the agreement with written notice if the other party breaches any material term of the agreement and fails to cure such breach within 30 days of receiving written notice. In case of termination, the client shall pay for all Services rendered up to the termination date.

9. Refund Policy

Our refund policy varies by service and will be outlined in your specific agreement. For most services, we offer a satisfaction guarantee within the first 30 days. Please refer to your service agreement for specific details.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect.
